·For popular courses, a non-refundable deposit may be required to secure a place. Such deposit can be used as a deduction of the tuition fee at formal enrollment or

Fee Payment and Late Payment
學費支付和逾期支付


·乙方應在本協議簽署后五日內,或在第一堂正式課開始前1天向甲方全額繳付學費,以早的日期為準。
·Program fees must be paid in full by party B 5 days after this agreement is signed or before the commencement of the program, whichever is the earliest.
· 若乙方在第一堂課開始時仍未全額支付學費,甲方有權利拒絕乙方參與相關課程。
·Party A reserves the right to refuse entry to party B if fees have not been paid on or before the first lesson/activity.
·若乙方在第一堂課開始后,仍有尚未結清的費用,甲方有權就未付款部分按照每日萬分之五向乙方收取滯納金。
·Party A reserves the right to charge party B a penalty at 0.0005 per day of unpaid fee if an invoice remains unpaid after the commencement of the first class.
·若在第一堂課開始時或者注冊登記后乙方尚未全額支付學費,學位將不保留,若屆時乙方所報課程滿班,乙方需等待甲方有空余學位,或轉至其他有空余學位的課程。若乙方已支付定金或其他費用的,一律不予退還。
·If the program fee is not paid at the commencement of the first session or after the enrollment, the place will be released to other potential students. Party B will be put on waiting list or transferred to other program with vacancy if the program is full, deposit or any other fees paid by Party B will not be refunded.



Course Refunds
退款


·乙方入學后因故要求退費的,須向甲方提出書面申請,闡明理由并出具書面的材料和憑證
·Refunds for exceptional circumstances are provided subject to providing a written application with supporting documents.
·A因甲方的原因造成乙方無法完成學習計劃的情況,乙方要求退學退費,甲方予以退還剩余的費用,計算方式:乙方所繳納的費用-已消費的費用=剩余學費。
·If party A is not able to provide the program, refunds of the residual amount (total tuition paid by party B – sessions already taken) will be provided to party B. 
·B開課前,乙方因不可抗拒的原因,如乙方搬離甲方所在城市或武裝部門的應征入伍通知書或因重大疾病、意外傷亡等正當理由提出退學退費申請,而提出退學退費申請的,甲方扣除·5%手續費,再予以退還剩余的費用,具體計算方式如下:
·乙方所繳納費用-已消費的學費-乙方所繳納費用*5%=乙方所得退款。
·Before the start of the program, refunds for exceptional circumstances such as leaving the city where the program is being delivered, long-term illness/injury, death can be provided upon receipt of valid supporting documents. Service charged at 5% of total tuition fee will be deducted from the refund. The calculation of refund is: total tuition paid by party B – sessions already taken – 5% of service charge
·C開課后除非因不可抗拒的原因(如乙方搬離甲方所在城市或武裝部門的應征入伍通知書或因重大疾病、意外傷亡等)否則甲方不接受任何的退款要求,申請退學或退費的情況:
a. 開課后15天(含) 剩余學費-20%*所繳納學費=退款金額
b. 開課后16-30天內 剩余學費-25%*所繳納學費=退款金額
c. 開課后31-180天內 剩余學費-35%*所繳納學費=退款金額
d. 開課后181天及以上不予退款。
·After the start of the program, refunds for exceptional circumstances such as leaving the city where the program is being delivered, long-term illness/injury, death may be provided upon receipt of valid supporting documents. Refunds are calculated as followings:
a. 15 days including the 15th day after the start of the program, residual amount – 20% of total tuition fee paid
b. 16 to 30 days after the start of the program, residual amount – 25% of total tuition fee paid
c. 31 to 180 days after the start of the program, residual amount – 35% of total tuition fee paid
d. 181 days after the start of the program, no refund
·退款按照付款方式原路退回,并由乙方自行承擔可能由此造成的相應手續費。(例如微信轉賬付款的,微信退回;刷銀行卡付款的,退回支付銀行卡)
·The refund will be done via the original payment method, Party B will be charged with any surcharge happened.
·退款前,乙方需向甲方返還原始發票、收據原件。
·Party B shall return the original invoice or receipt to claim the refund.
·退款將根據乙方實際支付費用及剩余課程次數或時間進行核算。若有其他甲方贈送的課程,則在退款時不計入核算范圍,乙方提前退款即放棄享有贈送課程的權利。
·The refund will be calculated based on the payment that Party B paid at the registration and the residual sessions of the program. Party B agrees to give up the right of any extra free sessions/program offered by Party A at the registration if the refund happens.



Register & Attendance
注冊和簽到


·出于安全考慮,甲方的教職員工會在課程開始前為每位乙方學員點名。
·A register for each class is maintained by the teacher and records student attendance for the purposes of health and safety and security.
·乙方上課采用簽到制,請乙方家長及監護人在抵達甲方時及時簽到。
·All students must be registered for the classes they attend. Any unregistered students will not be able to participate in the class. 
·若因甲方授課老師病假或其他不可預見的原因而取消課程,甲方將向乙方提供一個合適的代課老師或重新安排課程。課程可能會被安排在一個與原來課程不同的時間,有可能引起學期的延續,在此情況下,甲方不予退款。
·If a class is cancelled due to the sickness of the teacher, a health epidemic or any other unforeseen event, the Academy will endeavor to either: a) provide a suitable substitute teacher for that class; or b) reschedule the class. This may be on a different day or different time or both from when the class was originally scheduled, and might invoke an extension to the term time dates. No refund will be given in this case.
·上述原因以外,如甲方無法及時提供代課老師或重新安排課程的,甲方會向乙方提供課時憑證(Credit Note)。
If Party A is unable to provide a suitable substitute teacher or reschedule a class, a credit note will be supplied for use towards any existing classes already paid. Please note that due to the nature of the social activity within group courses, these generally cannot be offered a reschedule and can only be offered substitution or credit note.



Classes Missed
缺課和補課


·參加一對一課程的乙方,如無法參加已預定課程,請至少提前8小時通知取消,此次不計入課時;如未在8小時前通知,則計課時一次。一對一課程10節課起報,非甲方原因的乙方報10節課的可以請一次假,報20節課可以請二次假,以此類推,請在規定時間內完成課程。
·For any private program, Party B is required to inform Party A no later than 8 hours before the class starts if the student will be absent, or the fee will be otherwise charged and a make-up class will be unable to be provided at a later date. Class extension is allowed once for registration with 10 sessions, twice for registration with 20 sessions and so on. Any remaining sessions after the expiry date will become invalid.
·按學期/學年收費的課程,不提供請假和補課機會。如因生病的原因不能出席課程,請提供醫院開具的有效病假證明,甲方將根據醫院病假證明提供課時憑證(Credit Note),一個學期內限二次,該課時憑證僅適用于抵扣下一學期的相同課程。若下一學期內甲方取消該課程,乙方的課時憑證可用于其他團體類課程,按次抵扣。課時憑證不可作為現金使用,若發生退款不計入退費金額內。
·No make-up class is to be arranged for the academic year/term base program. In case of illness, up to two class credit notes will be provided upon a valid doctor note, such credit note can only be used for the same program in the following term. If such program is canceled by party A in the following term, the credit note can be used to other available group program. Credit note can not be cashed and is nonrefundable.
·夏令營、冬令營等短期型的課程,甲方不提供請假、補課或課時憑證等的政策。
·For short-term courses such as summer camps and winter camps, no credit note or make-up class will be offered.



Examinations
考試


·甲方提供以下課程的考級:英皇考級和倫敦圣三一考級。經甲方老師評估合格的乙方可去參加考級課程。
·Party A offers examinations with the following examination boards: Trinity College London; The Associated Board of the Royal Schools of Music (ABRSM). Students will only be entered for examinations when they have reached the required standard and at the discretion of the teacher.
·甲方會向乙方提供需要家長或監護人簽名的考試注冊表格。一旦成功注冊,所有考試相關的費用需在表格上寫明的日期前全額支付。所有延后支付有可能導致報名不成功,或者收取額外費用將不予退還。
·Party B will receive an examination entry form to be signed and completed by their parent/guardian. Once entered, the examination fee (separate to course fees) must be paid in full by the date specified on the form. Any late payments will incur an extra charge, assuming the examination board in question will accept a late entry. No refund will be provided if the registration fails due to late entry.
·在報名成功后,如果乙方連續兩周或以上未能參加相關課程的,將被取消考試資格,除非乙方能夠提供相應符合該考試機構要求的醫院病假證明,否則所有支付的跟考試相關的費用將不予退還。
·Party B who misses 2 or more consecutive classes after being entered for an examination will be withdrawn from the examination session. No reimbursement will be given, unless a valid Doctors note is provided. Reimbursement due to medical reasons will be given at the particular examination boards discretion and guidelines.
·其他由于乙方自身任何行為操守原因引起的,甲方保留取消乙方參加考試的權利。
·Party A reserves the right to withdraw Party B from an examination at any point due to misconduct.


Dress Code and Uniform
著裝要求


·出于乙方安全的考慮,除因演出服裝的特別需求,乙方應穿著簡單舒適的服裝來參與課程,團體課程不允許佩戴任何首飾,否則由此引起的一切對自己或第三人造成的人身、經濟賠償責任,將由乙方自行承擔。
·Party B should dress appropriately for their classes, with hair tied back neatly if required. Jewelry must not be worn for any group classes, unless specified as part of a costume. 
·對于乙方需要購買甲方統一的制服和其他相關的用品的課程,甲方會在該課程中單獨列明。
·Party B may be required to purchase a specific uniform or other program related materials. This will be clearly highlighted before the commencement of the program.



Safety and Code of Conduct
乙方安全條例和行為規范


·11歲以下的乙方必須有家長/監護人接送參加課程。甲方建議5歲以下的乙方家長/監護人在上課期間留在家長等候區等候,并保持等候區安靜。所有乙方在上課期間都必須符合甲方的操守守則。
·Party B under the age of 11 should be accompanied to the Academy by a parent/guardian or responsible adult. Adults with students under the age of 5 are advised to remain in or within close proximity to the Academy and enjoy the waiting areas until the class is finished.
·所有乙方在場地內須保持行為端正。
·Party B are expected to conduct themselves appropriately throughout the building.
·甲方會提供一份乙方行為操守手冊,若乙方嚴重違反行為操守手冊,甲方保留拒絕乙方繼續參加課程的權利,所有支付的費用將不予退還。
·A Code of Conduct will be issued to students and parents/guardians. Failure to observe the Code of Conduct may result in students being asked to leave. Party A reserves the right to refuse any student prior to or after enrollment. No refund will be given if the Code of Conduct has been invoked.
·如乙方有任何的過敏、哮喘或其他可能引發突發性疾病的病史及醫療狀況,父母/監護人須在注冊入學時書面通知甲方,否則由此可能造成的所有責任,由乙方及乙方父母/監護人自行承擔。
·It is the parent/guardians duty to inform Party A, in writing, of any special circumstance or adjustment for a student – severe peanut allergy, asthma medication etc.



Classroom requirements
課堂要求


·乙方不允許將飲用水以外的任何食品帶入課堂。
·Party B may not bring food into class, but may have a water bottle with them for hydration (no glass or cans please).
·為盡量減少對課程的中斷,建議乙方在課程開始前處理好個人事務(如更換衣物、上洗手間等)
·Please ensure that all students have been to the toilet or changed before class, to avoid any disruption to learning.



Student Equipment
乙方物品


·請乙方和父母/監護人保管自己的私人物品,乙方私人物品應在每堂課課程結束后自行帶離。
·Party B and legal guardians are responsible for taking care of all course-related work/resources and personal belongings. Please make sure all student equipment/personal belongings are taken home - particularly at the end of term.
·對于遺留在甲方場地內的任何私人物品的遺失、損壞,失竊,甲方將不負任何保管或賠償責任
·Any items left at the Academy are done so at the owner’s risk and the Academy cannot be held responsible for any loss/theft/damage.
·對于遺留在甲方場地內的任何私人物品,甲方有權將其視為無主物自行處置。
·Please note that Party A reserves the right to dispose of any left items that are not claimed after 3 weeks.



Right reserved by Party A
保留權利


·如乙方所報課程設有最低開班人數限制,在未達最低開班人數無法開班的情況下,乙方可選擇:其他時間段的相同課程;或課程費用全額退款(請參閱退款政策)。
·Some programs have minimum students number requirement. In case the program that the student has enrolled fails to meet the minimum number before the start of the program, party B may choose a same program at different time slot or a full tuition fee refund (please refer to the refund policy)
·公共假期甲方不對外開放。在公共假期內的課程,將調換到另一個合適的日期,并提前在甲方網站或微信公布,請留意網站及微信更新信息。
·The Academy does not operate on Public Holidays. Should a lesson fall on this date, Party A will endeavour to reschedule to a later date, such noticed will be announced on our website or Wechat in advance.
·甲方保留不作預先通知改變甲方課程時間的權利。
·Party A reserves the right to alter the advertised program and faculty without prior notice.
·甲方保留替換同等背景及專業資格老師的利。
·Party A reserves the right to replace the current tutors with others of similar background and professional qualifications .
·甲方保留根據實際情況,調整并改變學員所應遵守條款及規范的權利,并在調整后及時向乙方告知。
·Party A reserves the right to change these terms and conditions at any time and provide all students with the updated copy as soon as it is finalized and sent to print.

Waiver
特別事項


·出于教學及乙方安全的原因,在某些情況下,乙方和老師之間會有身體接觸,如拉手、糾正動作的觸碰等。如果乙方對此類接觸有顧慮,請及時和甲方聯系。
·In some instances, physical contact may be necessary by members of the teaching faculty. This is to ensure safe practice and correct technique. This includes physical contact between other students, for example holding hands. If you have any concerns regarding this matter, please contact the Academy.
·由于甲方的課程安排和老師都是普通教育,暫不接受特殊教育兒童。
·Due to the program arrangement, Party A is not eligible to accept any special needs students.



Data Protection and Privacy Policy
隱私條款和數據保密


·甲方承諾所收集的乙方個人信息,將嚴格保密并不對外泄露。
·Any personal information collected by Party A will be kept strictly confidential and will not be disclosed to the public .
·乙方注冊登記信息發生改變,請以書面的形式通知甲方。除非考試機構要求提供乙方信息,甲方承諾所有信息僅供內部使用。
·Please ensure Party A receives any changes to Party B’s registration details in writing. All details will be held in strict confidentiality and be passed to outside parties, apart from examination boards.
·甲方會提供考試機構參加考試的乙方相關信息,此類信息包括但不限于乙方的姓名、年齡及以往考試的情況和相關的聯系方式等。
·The examination boards hold information about Party B who is participating in syllabus examinations. This information includes the name and age of the participating students, any past examination successes and may also include the contact details provided by Party B.



Copyright & Parents
家長版權須知


·為保證課堂的質量,甲方不建議家長/監護人旁觀上課過程。家長監護人允許在公開課或者公開表演的時候觀看。同時甲方保留取消公開課的權利。
·For the benefit of the students’ learning, we ask that parents/guardians do not usually watch classes. Parents/guardians are invited to view classes on open class, which is generally held once a term, and other regular performance opportunities are provided. Party A reserves the right to cancel open class.
·父母監護人可以錄制或者拍攝表演或演出的照片/錄像。拍攝的作品僅限于個人使用。
·While parents may use their personal electronic devices to record their children, Party A urges parents to be aware that any video recordings or photography they make must feature/focus on their child only. Recording is for personal use only.
·相關的攝錄設備應在不影響老師和其他乙方上課的情況下使用,在拍攝時請關閉閃光燈。拍攝的作品不允許用作商業獲利用途。甲方保留對任何未經甲方授權而用于商業用途的拍攝追究法律責任。
·Recording devices must not distract teachers and children, must not interrupt the class and may not be used for commercial gain. Party A reserves the right to take any further legal action against unauthorized, misusage of relevant media content.

iStage Academy版權須知


·甲方會將乙方上課或演出的照片、錄像內容,用于推廣或其他市場宣傳,若乙方不希望您的孩子出現在相關的推廣媒體資料上,請以書面的形式通知甲方。
·Please inform us in writing if you do not wish Party A to use photography/video recordings of your child for any Party A’s future public events. This may include, but is not limited to; onsite/offsite public performances and promotional display and distribution.
·甲方有權將任何照片/錄像用于甲方組織或參與在學院場地內外舉辦的活動。
·Party A reserves the right to retain and use any photography/video recordings within the venue and at any off-site outdoor events, funded or organized by us.



Continuity
續課


·對于已注冊的乙方享有優先續課權。
·Current students at the Academy have priority for continuous enrollment.
·乙方應在新課程開始前至少6個星期與甲方重新簽訂協議并支付全額學費,過時甲方將認為乙方自動放棄新課程的注冊,并有權把課程名額讓給其他等候的第三方。
·Party A asks that registration and payment of the tuition fees be completed 6 weeks in advance before commencement of the following term, otherwise Party A will assume Party B is no longer active, and the place in the class will be allocated to another student.


   
Dispute Resolution
爭議的處理

·在履行本協議過程中,若甲乙雙方產生爭議,應協商解決。若協商不成,甲乙雙方均有權向甲方所在地人民法院提起訴訟。
·The Parties will attempt to settle all disputes arising under or in connection with this contract through consultation and negotiation in good faith and in a spirit of mutual cooperation. If such consultation and negotiation fail, the concerning party may bring a lawsuit in a People's Court where Party A is located in accordance with the applicable law.
·本協議任何不一致,以中文版本為準。
·The agreement is in Chinese and English respectively, if they have differences, the Chinese language version shall prevail.
